News on the Cyber-Resiliency Act

Greetings Directors, At our in-person board meeting in Vancouver last month, our lawyers at DLA Piper presented a landscape of regulatory threats and challenges that could affect open source in the near future. One of those challenges was the Cyber-Resiliency Act, a proposed legislation in the EU that aims at introducing safety best practices in digital products. Unfortunately, the initial text proposed by the EU Commission was drafted without much input from the open source community, and failed to take into account the specificity of our development model, potentially resulting in a chilling effect for developers and organizations involved, or the fragmentation of our global communities. We participated in the community response by posting our position[1], aligned with our partner organizations in the open source world. The next steps were to wait for the new versions of the proposed legislation as the EU Parliament committees worked on their own version, to see if they included any further provisions to protect open source or not. [1] https://openinfra.dev/blog/openinfra-foundation-cyber-resilience-act The Parliament version of the text was recently presented, ahead of the ITRE (Industry, Research and Energy) committee vote on the draft. I personally reached out to ITRE committee members asking to delay the vote, but the committee nevertheless approved it on a vote[2] *yesterday morning*. [2] https://www.europarl.europa.eu/news/en/press-room/20230717IPR03029/cyber-re… The new version of the text now contains further precision to exclude from its scope open source software developed using a “fully decentralised development model”, which matches the principles under which OpenInfra software is being developed (the Four Opens). However, this provision is superseded by other provisions squarely placing any project with developers employed by commercial entities within the scope of the act, which basically covers nearly all of open source software produced today. The text also contains no improvement on the process itself, for example still requiring that vulnerabilities be disclosed to ENISA within hours of discovery, even if no patch has been developed to fix them. This is orthogonal to vulnerability management best practices (like limiting access to unpatched vulnerabilities to the key people able to fix them, or responsible disclosure), while making the ENISA database a single high-value target for hackers in search of unpatched vulnerabilities. Adoption by the ITRE committee does not mean the fight is over, or the text final and approved. Now that it’s gone through the three committees involved (LIBE, IMCO, and ITRE), the text becomes a proposal to be voted on by the full Parliament. It is unclear at this stage if there will be a specific discussion and a free vote on it, it will depend how consensual or controversial it appears to be. In parallel, the EU Council (representing national governments) will prepare its own version of the text, and in the end all proposed acts will be reconciled into a single version that will become law. At the OpenInfra Foundation level we will follow next steps with attention, and participate in any industry initiative to improve this text to take into account the specificities of our global, collaborative value creation model. More specifically, we collaborate with the Open Source Initiative, Open Forum Europe, Linux Foundation and others to coordinate and support industry response. OpenInfra Summit Vancouver Highlights

Hi everyone, Thank you to those who were able to join the OpenInfra Summit Vancouver in person as well as those who participated remotely or followed along online. It was a great week filled with a lot of energy from the attendees representing over 350 organizations from 50 countries around the world. I’d also like to extend a huge thank you to the organizations who sponsored the OpenInfra Summit, especially our Headline sponsor Wind River and Premier sponsor Okestro. A lot happened over those three days, so I wanted to share a few highlights with the Board of Directors: There was a lot of onsite excitement around the launch of OpenInfra Europe and OpenInfra Asia. The OpenInfra Foundation hosted an onsite meeting for each hub that was well attended with participating organizations asking how they can get more involved. I personally talked to several attendees who were attending the OpenInfra Summit specifically to learn more about StarlingX, which was great to hear—especially as the community gathered to celebrate its 5 year anniversary. Ant Group and Microsoft contributors met onsite to discuss increased, long-term collaboration around Kata Containers. The Microsoft team was very excited to engage with the community to have their developer team contribute back upstream. I look forward to seeing much more collaboration happen here. We had a lot of particularly technical keynote demos, which seemed to resonate really well with the audience. They covered everything from LOKI using Magnum to AI with OpenStack and an AI confidential computing use case with Kata Containers. Hi, I'm reaching out to you as a follow up to one of the ideas that was brought up during the OpenInfra Board of Directors (BoD) meeting in Berlin on June 6, called Community Blueprint. The prupose of this email is to raise awareness of the activities around the idea and invite you to participate in next steps, if you are interested. A few of us from the OpenInfra Foundation staff and BoD met recently to discuss the idea in a bit more details and identify goals and next steps. Hello team, I wanted to let you all know that I will not be a part of the Gold member election this time around. Cisco leadership has determined that we won’t renew our sponsorship for next year. It has been an absolute pleasure being a part of this community for the last decade+. Since I got involved in OpenStack in early 2011, I have seen this community grow and thrive and so much of it is because of folks like you who have dedicated so much time and effort into building the greatest OSS community on earth. Greetings, The next meeting of the OpenInfra Foundation Board of Directors will occur on Tuesday December 6th between 2100 and 2300 UTC. This is our last scheduled meeting of 2022. During this meeting we will be review and approve the budget for 2023, and discuss and vote upon on a proposal to move forward with an European entity for the Open Infrastructure Foundation. Beyond our other general updates which will occur, the OpenStack TC has requested to address the Board regarding the current state of internationalization translations in the OpenStack community.
